Richard Channing will be represented by Attorney Allison Margolan. Richard Channing is not a pothead or dealer. He is a medical professional and qualified medical marijuana patient engaged in legitimate clinical application of marijuana in accordance with court agreed upon limits of 40 flowering plants. Richard Channing grew 14 plants this year, well within the limits set by his court agreement, yet he was arrested for "cultivation" with "intent to sell".
79% of Californians expressed through their votes that they are in favor of medical marijuana as is our Governor elect Schwarzenegger, so why is Richard Channing in jail?
Richard Channing believes that San Bernardino County Sheriff's Narcotics Officers and the District Attorney have entrapped him in order to protect their Federal Block Grant of in excess of $19 million dollars a year. Each year the San Bernardino County Sheriff's Department receive million dollar block grants to implement Federal drug policies that run contrary to our State compassionate use act of 1996, a voter initiative.
Sheriff Penrod has publicly stated that he does not support Proposition 215 and will arrest anyone attempting to implement it. County Supervisor Postmus said that he believes we should follow the Federal standards. Their actions and statements are contrary to the intent of the law in the State of California.
So how can Richard Channing receive a fair hearing in San Bernardino where all Judges enter the bench only if they receive endorsements by the County Supervisors and same law enforcement bodies? Where the Judges are beholden to the Board of Supervisors for $20,000 in supplemental pay per year and receive legal representation by the County Counsel?
