Dear Judge Goodwin,

I recently read an attorney’s motion filed in federal courts in which I learned that our courts are refusing to uphold our unalienable right to the due process of law.

I learned that it is not true that our Supreme Court ruled that all wheat is subject to regulation by the federal government and its agencies, but only that of persons who registered for benefit under the federal wheat program.

In both the Alden and Landa criminal cases this issue has been presented before the Ninth Circuit without yet being considered or responded to. Doesn’t the right to due process of law require that this issue of agency jurisdiction be heard and a clear judicial ruling be made in written opinions? If the due process of law is not upheld, do we even have a system of law? Aren’t we left with only a moral political agenda that’s being upheld by our federal judges, who present it to We the People as if it were the law?

In spite of the Supreme Court’s clear rulings in the Wickard v. Filburn case, the case has been misapplied for over 60 years by the Department. of Justice and the courts, while lawyers are unwilling to mention the fundamental issue and their clients are sent to prison. Isn’t it time to start abolishing this Department of Justice scheme “to regulate virtually everything,” as Justice Thomas wrote in the Raich case? Hasn’t this scheme resulted in the creation of a huge and rapidly expanding prison system, one that now holds 25% of the world’s prisoners in a nation with only 5% of the world’s population? Isn’t this scheme illegal, unlawful and criminal, as it deprives We the People of Our liberty and property without due process?

Perhaps it’s time that our courts exercise Article 3 judicial powers independent of the political moral issues masqueraded as law by the executive and legislative branches?

I respectfully request that you uphold your sworn duty to our Constitution and the rights it secures for We the People, including the right to due process, by responding in a written opinion to this issue of agency jurisdiction, as people’s lives and liberties weigh in the balance.
