Performance Agreement
Description of Sound System:
Upon reasonable notice, additional equipment may be requested.
Submission Policy. All material must be original and copyrighted. Include Bio, Photo, 3 Song Demo with lyric sheets and Full Press kit. Material is not returned unless requested with SASE. Material should be packaged and ready to be forwarded to Record Labels. If you are a producer looking to work with us, you must submit material with 5 tracks Max and lyric sheets. Producers must own their equipment or a full studio to qualify. Writers are encouraged to submit as well. Again, all material must be copyrighted. Music genres should be in Pop, R&B / Hip-Hop only. Bands or groups are welcome to submit if you fall into any of those categories.
Indemnify for Copyright Infringement. Artist(s) represent and warrant that they are knowledgeable about the copyright laws of the United States as applicable to the Performance, and that Artist(s) shall not perform any copyrighted materials of others during performance without full compliance with such applicable copyright laws. In the event that Artist(s) breach this representation, warranty and covenant, Artist(s) hereby agree to INDEMNIFY AND HOLD HARMLESS Buyer and its employees, guests and agents from and againstall liability, loss, damages, claims, and expenses (including attorney's fees) arising out of such breach.
Sound Check. The set up and sound check time with full access to stage and P.A equipment on the date of performance shall be at 10:30 A.M sharp! Have your show formatted CD ready NO EXPLICIT LYRICS!!!
Security. Employer will provide sufficient security so that no unauthorized persons will have access to the stage Area or the V.I.P area. The Artist(s) will provide names of personnel or staff authorized to be at the V.I.P area. Artist/Musician/Talent(s) shall be responsible for any theft or damages to the equipment of Artist/Musician/Talent(s) that may occur during the time that the equipment is located on Employer’s premises. Musician/Artist/Talent(s) will be responsible for breaking any equipment due to their negligence.
Transcription. No performance and/or this performance shall be recorded, video taped, reproduced, transmitted, or disseminated in or from the place engagement in any manner or by any means whatsoever in the absence of a specified written agreement with the Employee.
Cancellation. In the event Artist(s) cancels the Performance less than two weeks prior to the scheduled date for reasons other than sickness and of accidents, acts of God, war conditions and other reasons beyond the their control, The Artist(s) will pay the other a sum equal of the deposit $100.00 or forfeit your fee. This amount reflects the guarantee due to the Artist(s) by the Entertainment Network Group and the promotional expenses typically expended by the Entertainment Network Groupin preparing for Musician's performance. Upon payment of the cancellation fee, neither the EntertainmentNetwork Group or Artist(s) will have any further liability to the other under this Agreement.
Promotion and Production. Employer shall be responsible for all matters pertaining to the promotion and production of the scheduled engagement, including but not limited to venue rentals, security, and advertising. Employer agrees to promote the scheduled performance(s) and will use its best effort to obtain calendar listings, feature articles, interviews of the Artist, reviews of the performance and Artist’s records in all local print, radio and television media. Performers are expected to promote the general rules for personal conduct to their guests and fans. Any parties involved are found to be encouraging the breaking of these rules, they will not be invited back.
Merchandising. Artist shall have the option to sell CDs, books, and/or merchandising materials at the performance. However, Employer is not responsible with damaged or lost items. You are also welcome to hang up poster inside of the club only. No promotional materials can be distributed or sold outside of the predesignated area. We will provide you space and merchandising table and chairs. Artist(s) will retain all proceeds from such sales. You must notify us 72 hours prior to the engagement.

Performance
Agreement
Insurance. Employer agrees to retain any and all necessary personal injury or property damage, liability insurance with respect to the activities of Artist/Talent(s) on the premises of Employer or at such other location where Employer directs Artist/Talent(s) to perform. Employer agrees to indemnify and hold Artist/Talent(s) responsible any and all claims, liabilities, damages, and expenses arising from any action or activity of Employers and Artist while Artist/Talent(s) is rendering the contracted services except for claims arising from the Artist’s willful misconduct or gross negligence.
Disputes. In the event any dispute arises under this agreement that results in litigation or arbitration, the losing party shall pay the prevailing party its reasonable attorneys’ fees and cost.
This contract shall be governed by CALIFORNIA Laws, may be modified only by signed writing, and is binding and valid only when signed by the parties below.
*Management Comments. Only Artist(s), Dancers, and Manager(s) will be allowed in as V.I.P or designated Areas. Artists do not have a guest list. Only performing Artist(s) will be allowed on stage and V.I.P access. Security is strictly enforced. No exceptions. All performances may be subjected to a searched for DEADLY WEAPONS or ILLEGAL SUBSTANCES *NO OUTSIDEFOOD OR ALCOHOL BEVERAGES ALLOWED NEAR CITY HALL PREMISES. WE HAVE THE RIGHT TO TERMINATE THIS AGREEMENT AT ANYTIME AND RETAIN YOUR PERFORMANCE FEE.
IN WITNESS WHEREOF, The parties hereto have hereunto set their names and seals on the day and year first above written. Entertainment Network Group have each caused this Performance Agreement to be signed by its duly authorized representative.
